In order for someone to take custody of a child in the case of being orphaned they must either be the next of kin (and a suitable parent obviously) or be legally stated in a will. So unless you have a will that outlines who you want to be the legal gaurdian of your kids in the event of your death, then its up to the other siblings (if old enough) grandparents, brothers sisters etc. Quote Link to comment Share on other sites More sharing options...
